摘要
善意取得制度在保护第三人对物权公示的信赖、平衡善意第三人与原权利人利益方面发挥着重要作用,但在行政诉讼中善意取得制度如何影响法院撤销违法的不动产登记在实践层面存在分歧。通过对法院裁判思路和法律相关规范的分析,所有权的善意取得可以产生阻却撤销违法不动产登记的效果,而抵押权的善意取得可引入抵押权追及效力以保障权利实现,《民法典》对抵押物转让规则的重塑为此提供了依据。
The bona fide acquisition system plays an important role in protecting the third party’s reliance on the publicity of property rights and balancing the interests of the bona fide third party and the original right holder, but there are still differences in judicial practice on how the bona fide acquisition system affects the court to revoke illegal real estate registration in real estate registration litigation.Through the analysis of relevant norms and adjudication ideas, the bona fide acquisition of ownership can have the effect of blocking the revocation of illegal immovable property registration, but the bona fide acquisition of mortgage rights can introduce the mortgage retroactive effect to ensure the realization of mortgage rights, and the Civil Code provides a normative basis for the reshaping of collateral transfer rules.
