摘要
大数据领域滥用市场支配地位的命题饱受争议。该命题的证立是正确解决滥用数据市场支配地位问题的前提。目前学术界赞同与否定大数据领域滥用市场支配地位的两种学说及理论,都存在一定的局限性。证立该命题,应采取竞争效果分析与法律标准相结合进行论证。大数据领域滥用市场支配地位应区分为“数据市场的滥用市场支配地位”和“基于数据的滥用市场支配地位”,并基于“谦抑性”的审慎规制理念和新布兰代斯主义,将数据特性、数据控制能力和经济民主纳入法律认定标准。
The proposition of market dominance abusing in the field of big data has always been controversial.The justification of this proposition is the premise of successfully solving the problem of dominance abusing in the data market.At present,there is certain limitations with the two theories about the approval and denying market dominance abusing in the field of big data in academic circle.To justify this proposition,it should be demonstrated with the combining of competition effect analysis and legal standards.The market dominance abusing in the field of big data should be divided into“market dominance abusing in the data market”and“market dominance abusing based on data”.With the principle of prudential regulation concept about“modesty”and the Neo-Brandeisianism,the data characteristics,data control capabilities,and economic democracy are incorporated into legal recognition standards.
