乡村治理体系内在结构的厘清

Clarification on the Internal Structure of Rural Governance System

关于乡村治理体系的内在结构,学界提出了不同的观点,归纳起来主要有“一体两翼论”“箱式结构论”“三治组合论”“三治融合论”四种。这些不同的观点都有可取之处,同时也存在着一些不足。厘清乡村治理体系内在结构,既要考虑“乡村”与“村”差异的地域因素,也要考虑自治、法治、德治性质不同的内涵因素,还要考虑是“融合”还是“结合”的协同方式差异因素。基于以上因素,乡村治理体系需要在“乡”“村”两个层面采取不同的自治、德治和法治结合方式,而根据自治的性质和德治、法治的适用领域不同,乡村治理体系需要根据乡村不同事务选择不同的组合。

There are mainly four different views about the internal structure of rural governance system: “one body with two wings”,“box structure system”,“tri-governance combination”and“tri-governance integration”. Each viewpoint has its merits, but it also has some shortcomings. To clarify the internal structure of rural governance system, it is necessary to consider not only the regional factors of the difference between“township” and “village”, but also the connotation factors of autonomy, rule of law and rule of virtue, as well as the difference factors of “integration” or “combination” coordination methods. Based on the above analysis,the rural governance system needs to adopt different combinations of autonomy, rule of virtue and rule of law at the two levels of“township” and “village”. According to the nature of autonomy and the different application fields of rule of virtue and rule of law, in the rural governance system we need to choose different combinations according to different rural affairs.
