算法论证程序的意义——对法律规制算法的另一种思考

算法,在从处理实验数据的逻辑规则演变为处理社会数据的人机交互决策机制时,其概念含义发生了本质变化。对算法概念变化的忽视,导致了法律规制算法研究对研发与应用的阶段混同。而重实体、轻程序的偏好,更是引发了法律规制算法研究的碎片化争论。对此,算法论证程序,作为由法律要求算法应用主体按照特定标准和条件整理利益相关方意见后,对其算法应用的决定做出可使利益相关方理解与认可的沟通过程,其概念的提出有利于澄清现有的阶段混同,并纠正重实体、轻程序的偏好。同时,算法论证程序具有的相对客观合理性、衔接技术中立与技术向善性、多元价值兼容性,为法律限制算法权力恣意、解决算法黑箱问题和减少算法歧视提供了全新的沟通性视角。

When the algorithm evolves from the logical rule for processing experimental data to the human-computer interaction decision-making mechanism for processing social data, its conceptual meaning has changed essentially. The neglect of the change of algorithm concept leads to confusion of the stage of research and development and the application stage with regard to the algorithm research for legal regulation. Moreover, the preference for valuing entities and neglecting procedures leads to the fragmentation debate of the algorithm research for legal regulation. In this regard, the main body of the algorithm application sorts out the opinions of stakeholders according to specific standards and conditions, as required by law. And then the algorithmic argumentation procedure can make the stakeholders understand and agree with the decision of its algorithm application. The concept is conducive to clarifying the existing stage confusion and correcting the preference for valuing entities and neglecting procedures. At the same time, the algorithmic argumentation procedure is relatively objective and reasonable, and it not only ensures the neutrality and goodness of the technology, but also keeps the compatibility of multiple values. Thus, it provides a new communication perspective for the law to restrict the abuse of algorithmic power, solve the algorithm black box problem and reduce algorithm discrimination.
