法治视角下研究生导师行为的分类与规制

Classification and Regulation of Graduate Supervisor Behavior from the Perspective of Rule of Law

从法治视角规制研究生导师行为,是建设良性有序导生关系的重要思路。基于流程和内容,导师行为可以分为学业指导行为、学业管理行为、学业支持行为、其他职务行为、非教育行为等;基于合目的性、合理性与合法性,导师行为可分为正面行为、负面行为等。相同类型的导师行为具有类似的法律关系和法律性质。导师行为的法治规制可以从明确导师行为原则理念、完善导师行为规则体系、健全导师行为制衡机制这三个路径进行优化。

It is an important idea to regulate the tutor’s behavior from the perspective of rule of law to build a benign and orderly mentoring relationship.Based on the process and content,supervisor behavior can be divided into academic guidance behavior,academic management behavior,academic support behavior,other duty behavior,non-educational behavior,etc.Based on purposiveness,rationality and legitimacy,mentor behavior can be divided into positive behavior and negative behavior.The same type of tutor behavior has similar legal relationship and legal nature.The rule of law regulation of tutor behavior can be optimized by clarifying the principle and idea of supervisor behavior,perfecting the rule system of supervisor behavior,and perfecting the check and balance mechanism of tutor behavior.
