《民法典》背景下我国医疗知情同意履行方式探究

Exploration of the implementation method of medical informed consent in China in the context of the Civil Code

知情同意贯穿于整个医疗行为过程中,是医疗行为合法性的基础。现阶段医方在医疗活动中告知义务履行不充分是医疗纠纷发生的主要原因。《民法典》的颁布和实施对医疗知情同意的履行提出了更高的要求。现阶段《民法典》背景下,作者对医疗知情同意履行方式进行了分析探究,对于缓解医患矛盾、重建医患信任和解决医疗纠纷等具有重要的意义。

Informed consent runs across the medical behavior that is the basis of the legitimacy of the medical behavior. The main reason for medical disputes in China is the inadequate fulfillment of the obligation of the doctor in medical activities at present. The promulgation and implementation of the Civil Code have set forth higher requirements for the performance of informed consent. This study has an important institutional significance for the study of medical knowledge in the context of the current Civil Code, which alleviates the contradiction between doctors and patients, rebuilds the trust between doctors and patients, and resolves medical disputes.
