“感情投资”型受贿犯罪的证明标准

《关于办理贪污贿赂刑事案件适用法律若干问题的解释》第十三条第二款为“感情投资”型受贿犯罪之规定。“感情投资”型受贿犯罪的证明标准应当与《刑事诉讼法》的规定相符应。实现个案正义需要刑法与刑事诉讼法等学科的密切配合与通力协作,对任何案件的判处都必须达到法定证明标准。针对是否具有索取、收受行为;是否具有上下级关系和行政管理关系;财物是否价值三万元以上的案件事实的证明必须达到“证据确实、充分”的证明程度。认定“可能影响职权行使”则需要综合全案证据,结合经验法则,达到“排除合理怀疑”的证明程度。

Paragraph 2 of Article 13 of the Interpretation of Several Issues Concerning the Application of Laws in Handling Criminal Cases of Embezzlement and Bribery is the provision of emotional investment bribery. The proof standard of "emotional investment bribery " should be consistent with the provisions prescribed in the Criminal Procedure Law. The realization of case justice requires the close cooperation and coordination of criminal law and criminal procedure law, and the sentence of any case must meet the legal standard of proof, namely, whether it has the behavior of demanding and receiving, whether it has the relationship between superior and subordinate and administrative management, and the proof of the facts of a case in which the property is worth more than 30,000 yuan must reach the degree of proof that the evidence is true and sufficient. To determine that "it may affect the exercise of functions and powers" needs to synthesize the evidence of the whole case, combined with the rule of thumb, to achieve the degree of proof of "excluding reasonable doubts".
