在包容性理念日益凸显的背景下,其在法治实践中突出“法”建构与运行的包容性,这推动着大学治理通过软硬法融合的混合法模式寻求规则的包容,以“他治”和“自治”相结合的协同治理建立秩序的包容。前者强调大学以章程为核心的软法规范的自主建构以及与政府的联合创制,并在此基础上通过以法律保留原则勘定大学组织制度要素的边界、将制度要素有的放矢地介入大学内外部事务、构建制度要素协同运行模式等实现大学治理软法与硬法的衔接与整合;后者则在于持续优化传统的以管理为目的的行政监管秩序和不断拓展大学组织自律秩序,实现政府依法管理与大学依法自治的共建共治共赢。

In the context of the increasingly prominent concept of inclusiveness,it highlights the inclusiveness of the construction and operation of“law”in the practice of the rule of law,which promotes university governance to seek the inclusiveness of rules through a mixed-law model that integrates soft and hard laws,to establish order tolerance through collaborative governance that combines“heteronomy”and“autonomy”.The former emphasizes the independent construction of soft law norms with the constitution as the core of the university and the joint creation with the government,and on this basis,the connection and integration of the soft law and the hard law of university governance are realized by demarcating the boundary of the elements of the university’s organizational system with the principle of legal reservation intervening the system elements in the internal and external affairs of the university in a targeted manner,and constructing the cooperative operation mode of the institutional elements;The latter lies in the continuous optimization of the traditional administrative supervision order for the purpose of management and the continuous expansion of the self-discipline order of the university organization,so as to achieve a win-win situation of co-construction and co-governance between the government’s lawful management and the university’s lawful self-governance.
