数据是数字检察的基础,有效的获取数据是数字检察工作的核心问题。数据流通现处于数字技术限制、观念制约、制度限制等壁垒的重围之中。突出重围,关键在于确定数字检察的“数字”场域,明确数字检察的“数字”边界,实现场域内的数据依法依规、制度化的获取,从而破解外部数据共享难题。检察权的边界即是数字检察的数据边界,检察机关获取数据应以检察权行使的边界为限。

Data are the basis of digital prosecution,and effective data acquisition is the core issue of digital prosecution.Data circulation is now surrounded by barriers such as digital technology restriction,concept restriction and system restriction.The key is to determine the“digital”field of digital prosecution,define the“digital”boundary of digital prosecution,and achieve the acquisition of data in the field according to laws and regulations and mechanisms,so as to crack the problem of external data sharing.The boundary of procuratorial power is the data boundary of digital procuratorial,and the procuratorial organs should obtain data within the boundary of procuratorial power.
