监察机关商请检察机关提前介入职务犯罪案件工作机制的完善

The Improvement of the Working Mechanism of Supervision Organs Inviting Procuratorial Organs to Intervene in Duty Crime Cases in Advance

监察机关商请检察机关提前介入办理职务犯罪案件,是实现宪法、监察法关于监检之间“互相配合、互相制约”原则的重要措施,对监察机关规范取证工作、完善证据体系、准确适用法律和强制措施发挥着重要作用。为保证监察执法与检察司法办理职务犯罪案件工作时衔接顺畅,应当依照规范化、法治化的要求,从提前介入的时间节点、案件范围、主体形式、工作方式、意见效力等方面系统完善,建立提前介入双向启动选择权,适当调整提前介入的时机和期限,合理界定提前介入的范围和方式,明确提前介入的主体和意见效力。

There are differences in the legal basis and value significance between the supervisory organs inviting procuratorial organs to intervene in handling duty crime cases in advance and the procuratorial organs initiating intervention in investigation activities,the joint handling of cases by discipline inspection and procuratorial organs before the reform of supervisory system,and the early intervention of procuratorial self-investigation cases.This mechanism is an important measure to realize the principle of“mutual cooperation and restriction”between the supervision and inspection departments in the Constitution and the Supervision Law,and plays an important role in standardizing the work of the supervisory organs in obtaining evidence,improving the evidence system,and accurately applying the law and compulsory measures.In order to ensure the smooth connection between supervision and law enforcement and procuratorial justice in handling duty crime cases,we should,according to the requirements of standardization and rule of law,systematically improve the time node of advance intervention,the scope of the case,the main form,the way of work,the effectiveness of opinions and other aspects,and establish the two-way starting option of advance intervention.The timing and duration of early intervention should be appropriately adjusted,the scope and method of early intervention should be reasonably defined,and the subject and effect of early intervention should be clearly defined.
