自然资源领域综合行政执法的实践与思考——以广州市南沙区为例

Practice and consideration of comprehensive administrative law enforcement related to natural resources: A case study of Nansha District of Guangzhou

自然资源领域纳入综合行政执法体制,符合我国快速城镇化的时代特征。该文以广州市南沙区为例,探讨了自然资源领域综合行政执法体制的设计实践、存在问题及优化建议。南沙区首创执法事项分级审批制度,近年来执法效能明显提升,同时也暴露出存在的问题:行政执法信息存在较高壁垒,部门之间未能建立有效沟通渠道;土地执法监管存在职责不清的问题,重整改、轻管护;“非粮化”问题管控缺位;综合执法制度设计不够完备,规划和自然资源管理所监察缺位,执法队力量不足。针对这些问题,提出优化建议:一是重新赋能规划和自然资源管理所,同时,加强对执法部门辅助人员的培训和激励;二是构建用地数据及行政执法信息共享机制;三是划定耕地(基本农田)整备区,实行闭环管理。

Integrating natural resources into the comprehensive administrative law enforcement system is in line with the trend of rapid urbanization in China.This paper,taking Nansha District of Guangzhou as a case,investigates the design and practice of the comprehensive administrative law enforcement system related to natural resources,with the aim of identifying the problems and proposing useful strategies for this field.As suggested by the findings,recent years have witnessed a significant improvement of enforcement efficiency thanks to the initiation of hierarchical examination and approval system.However,there still exists a series of problems.Firstly,obstacles exist in the flow of administrative law enforcement information,which results in the failure of effective communication.Secondly,there are unclear responsibilities in land law enforcement between departments,leading to neglecting management and protection,and lack of control for "non-food" problems.Thirdly,there are design defects in the comprehensive law enforcement system,such as the lack of regulation and supervision,and the insufficient strength of the law enforcement team.In response to the problems,several suggestions are proposed in this paper.Firstly,re-empower the department for planning and natural resources management,reshape the duties of land supervision,and strengthen the training of law enforcement auxiliary personnel.Secondly,build a sharing mechanism of land use data and administrative law enforcement information.Thirdly,delimit cultivated land(basic farmland) reconditioning area and implement closed-loop management.
