党对立法工作的百年探索与经验启示——基于党的全国代表大会报告的研究

The Chinese Communist Party’s Centennial Exploration of Legislation and Insights from Experience——A Study Based on the Report of the Party’s National Congress

中国共产党的历次代表大会报告蕴含着对立法工作的系统认识,承载了党对立法工作的探索经验。百年之中,立法实践和理念不断适应革命、建设、改革的需要。尤其是改革开放以来,立法和改革关系的观念更新,立法深度嵌入依法治国体系,科学立法、民主立法、依法立法理念凸显,“良法”与“善治”的互动也日益加强。百年的经验表明,立法应符合我国政治体制、彰显民主价值、立足基本国情、坚持与时俱进、树立系统思维。

The reports of the successive congresses of the Communist Party of China contain a systematic understanding of legislative work and carry the Party’s exploration and experience of legislative work. Over the past century, legislative practices and concepts have been constantly adapted to the needs of revolution, construction and reform. In particular, since the reform and opening up, the concept of the relationship between legislation and reform has been renewed, legislation is deeply embedded in the system of the rule of law, the concept of scientific, democratic and law-based legislation has come to the fore, and the interaction between “good law” and “good governance” has been increasingly strengthened. Centuries of experience have shown that legislation should be in line with our political system, manifest democratic values, be based on the basic national conditions, keep abreast of the times and establish systematic thinking.
