摘要
获得公正评价权,即受教育者在受教育过程中主张根据自身的学业、品行表现获得合理评定的权利。确认受教育者享有获得公正评价权,不仅是发展身心、健全人格的必要内容,更是从公民权角度尊重人的尊严的内在要求。从权利谱系上看,获得公正评价权是受教育权下的一项子权利,属于受教育权体系中享有受教育成果的范畴。大学自治、学术自由、专业判断等问题都不足以构成排除司法审查学生评价行为的充分理由,在承认“判断余地”理论的基础上肯定司法对评价行为的有限审查,并不违反司法节制的原则,亦不会对高校学术自主以及教师学术权威造成损害。
To obtain the right to fair assessment means the educated claim the right to obtain reasonable evaluation according to their own academic and conduct performance in the process of education.To confirm that the educated enjoy the right to fair evaluation is not only a necessary content of developing body and mind with sound personality,but also an inherent requirement of respecting human dignity from the perspective of citizenship.From the perspective of the right spectrum,the right to fair evaluation is a subright under the right of education,which belongs to the category of the system of the right of education.University autonomy,academic freedom,professional judgment and other issues are no excuses for excluding judicial review on students'right to fair evaluation.Limited judicial review of evaluation behavior on the basis of admitting"judging room"does not violate the principle of judicial moderation,and will not cause damage for academic autonomy as well as teachers'academic authority.
