“新法学”语境下金融法教学与金融实践的悖反与融合

摘要 长期以来,金融法教学与金融实践存在悖反关系。具体而言,金融法培养目标与金融职业定位产生背离,金融法课程与金融岗位需求有所偏差,金融法教学方式与金融法务训练发生互异。进入“新法学”时代,金融法教学迎来了新的实践性课题,有必要从金融法与金融学的跨学科交融、教学机构与金融部门的场景转换、理论学习与金融实操的能力提升、知识浇灌与实证推理的思维升华四个层面展开调试,从而为金融法教学指明方向。尔后在“新法学”语境下,应加强跨学科交叉培养,重构金融法教学体系;衔接金融法课堂与金融市场,开创场景化新教法;搭建师资交流培养机制,塑造双师型教师角色;开设金融法实证教学课,构建实证性思维法则。唯有如此,方能在“新法学”时代擘画出金融法教学与金融实践的融合图景。 For a long time,there has been a contradictory relationship between financial law teaching and financial practice.Specifically,the training objectives of financial law deviates from the financial professional orientation,the courses of financial law deviate from the needs of financial posts,and the teaching methods of financial law are different from those of financial legal affairs.In the era of“new science of law”,the teaching of financial law has ushered in new practical topics.It is necessary to debug from four aspects:the interdisciplinary integration of financial law and finance,the situation transformation from teaching institutions to financial departments,the ability improvement from theoretical learning to financial practice,and the thinking sublimation from knowledge pouring to empirical reasoning,so as to point out the direction for the teaching of financial law.Then,in the context of“new science of law”,the author of this paper suggests:(1)to strengthen interdisciplinary training and reconstruct the teaching system of financial law;(2)to connect the financial law classroom with the financial market and create a new contextualized teaching method;(3)to build a teacher exchange and training mechanism and shape the role of double qualified teachers;(4)to set up empirical teaching courses of financial law and construct empirical thinking rules.Only with these measures,can we draw a picture of the integration of financial law teaching and financial practice in the era of“new science of law”.
