The Risk of Copyright Infringement Recommended by Intelligent Algorithm and its Prevention

【目的】针对智能算法推荐产生的版权侵权风险,探究其背后成因,在此基础上按照平衡原则、平等原则和效能原则为防范这一风险提供科学的对策建议。【方法】探究平台使用算法编辑向用户推荐高适配性内容带来的算法技术不确定、认知不确定的侵权风险与规则的制度掣肘,剖析其在传播过程中的作用与地位,分析侵权风险的原因。【结果】算法推荐平台具有反“技术中立”立场与可责难性,其具有对算法推荐机制规制的前提和基础。【结论】我国需要在法律层面与社会层面形成合力,着力提升算法推荐平台的协同治理能力,以防范其使用算法推荐带来的版权侵权风险,促进相关制度规则在多元主体利益的动态平衡中与时俱进。

[Purposes] To investigate the causes of the copyright infringement risk caused by intelligent algorithm recommendation,and using this information as a foundation,to offer scientific countermeasures and recommendations to prevent this risk in accordance with the principle of balance,equality,and efficiency.[Methods] Explore the algorithmic technology and cognition uncertain infringement risks brought about by the platform using algorithm editing to recommend highly adaptable content to users,and the institutional constraints of rules,analyze its role and status in the dissemination process,and analyze the causes of infringement risks.[Findings] The algorithm recommendation platform is to blame for the regulation of the algorithm recommendation mechanism since it takes an anti-"technology neutral" stance.[Conclusions] In order to prevent copyright infringement threats brought on by the use of algorithm recommendation and promote relevant system regulations to keep up with the times in the dynamic balance of diverse subjects interests,our nation has to coordinate efforts to improve the collaborative governance ability of algorithm recommendation platforms at the legal and social levels.
