著作权废弃请求权下侵权物处置研究

Research on the Disposal of Infringing Articles under the Copyright Disposal Claim

著作权废弃请求权下侵权物处置是权利人为恢复对著作权的圆满支配状态,而依法请求法院处置侵权物的一种私权救济方式。现行著作权废弃请求权确立的销毁优先的侵权物处置规则,压缩了其他处置措施的适用空间,亟待完善。应当对处置措施中的销毁从功能,排除出商业渠道从利益,其他替代性措施从效果角度重新界定,坚持比例原则、绿色原则、利益平衡原则以及鼓励当事人协商原则,修改过于严厉的处置规定,构建多元考量的处置措施选择适用标准,加快形成科学高效的侵权物处置规则。

Disposal of infringing articles under the copyright disposal claim is a private right remedy for the right holder to request the court to dispose of the infringing articles in accordance with the law in order to restore the state of satisfactory control of the copyright.The disposal rules of infringing articles established by the current copyright disposal claim,which gives priority to destruction,has compressed the application space of other disposal measures and needs to be improved urgently.The destruction from the perspective of function,the exclusion of business channels from the perspective of interests,and other alternative measures from the perspective of effect should all be redefined in disposal measures.It is imperative to adhere to proportionality principle,green principle,interest balancing principle and encouraging consultation principle,and revise the overly harsh disposal provisions,establish multi-considered selection of applicable criteria for disposal measures,and accelerate the formation of scientific and efficient disposal rules for infringing articles.
