在全球化发展的背景下,通过知识产权保护传统文化艺术是公众关注的热点问题,然而,原住民社群因为历史背景、社会地位和文化表现形式的特殊性,他们的传统文化艺术保护既受到知识产权法律局限性的影响,也受到来自外界主流大众文化的冲击和威胁。因此,需根据当前原住民社群特性、涵盖原住民传统文化表达保护的法律条例以及各国的改革经验,探究在现行知识产权法律体系中原住民传统文化表达保护途径的优化方式。

In the context of globalisation,the protection of traditional culture and art through intellectual property rights is a hot issue of public concern.However,due to their historical background,social status and special forms of cultural expression,the protection of traditional culture and art of indigenous peoples is affected by the limitations of intellectual property laws,as well as the impact and threats from outside mainstream popular culture.Therefore,it is necessary to explore ways to optimise the protection of indigenous traditional cultural expressions in the current intellectual property legal system in light of the characteristics of indigenous communities,the legal regulations covering the protection of indigenous traditional cultural expressions and the reform experiences of other countries.
