Global Governance of Cross-Border Data Flows:International Comparison and China’s Strategy

互联网技术的不断发展和数字化的不断推进,让数字贸易逐渐发展成了跨境电商贸易的新引擎。跨境数据发展的同时,主权管辖、数据安全、隐私保护等风险问题也日渐凸显。文中基于中国国情及自身发展情况,借鉴国外优秀治理经验,取长补短,以期发现我国在数据跨境流动治理方面的漏洞、完善监管制度等,接轨全球数据跨境流动规则,抢占全球数据跨境流动制高点,从而更好地适应全球信息化的发展。

With the continuous development of Internet technology and digital technology,digital trade has gradually become a new engine for cross-border e-commerce trade.With the development of cross-border data,a series of risk issues such as sovereign jurisdiction,data security and privacy protection have become increasingly prominent.Based on ChinaLs national conditions and its own development,this paper draws on the excellent governance experience of foreign countries to learn from each other,improve the loopholes in China?s cross-border data flow governance,optimize the regulatory system,integrate with the global data cross-border flow rules,seize the commanding heights of global data cross-border flow,and better adapt to the development of global informatization.
