摘要
我国涉外法治人才培养历经量、质到效能的标准转变,需要从模式化的培养向多元化的建设进行范式转型。我国涉外法治人才建设面临优质生源流失严重、培养机制尚欠精细、学科融通尚有差距、理论实践脱轨较重、国际交流受阻较大等诸多较为严峻的现实困境。应以铸就能与时俱进地解决问题的综合能力为基本方略,综合采取超越学段设置的体系思维、跳出国际法视域的跨界思维、突破学校教育的共同体思维、跨越当下需求的前瞻思维和坚守中国立场的本位思维,五维并举探索涉外法治人才建设的效能提升之道。
The cultivation of the foreign-related legal talent in China has been enduring from the requirements of quantity, quality to the one of efficacy, and it is necessary to transform the paradigm from model cultivation to diversified construction. The construction of the foreign-related legal talent in China faces many serious practical difficulties, such as the loss of of high-quality students, immature cultivation mechanisms, big gaps in the integration of disciplines, serious derailment of theory and practice, and large obstacles to international exchanges. The basic strategy should be to keep pace with the times to create a comprehensive ability of solving problems, comprehensively adopt the system thinking that goes beyond the setting of the school stage, the crossborder thinking that jumps out of the field of international law, the community thinking that breaks through school education, the forward-looking thinking that goes beyond the current needs, the standard thinking of China’s position, and conduct five-dimensional exploration to improve the efficacy of the foreign-related legal talent construction.
