基于社会治理现代化的社区法律顾问制度优化路径研究

Study on the Optimization Path of Community Legal Counsel System From the Perspective of Modernization of Social Governance

社区法律顾问制度有利于发挥法治思维和法治方式在社会治理中的作用,助推社会治理现代化。社区法律顾问通过开展法律咨询、进行法律宣传、化解调解矛盾、参与社会治理等方式,满足社区治理的法律服务需求,服务于城市经济社会高质量发展。但目前仍存在法律咨询数量分布不均、法律宣传模式比较单一、化解矛盾方式方法略显简单、参与社会治理动力不足等问题。主要原因在于社区法律顾问制度知晓度、利用率有待提升、基层资源供给能力不足、评估机制不够完善以及工作理念方式有待创新。应从提升居民参与度与利用率、增强基层资源供给能力、完善全方位评估机制、创新社区法律顾问工作理念等方面进行优化完善。

The community legal counsel system is conducive to play the role of the rule of law thinking and the rule of law in social governance, boosting the modernization of social governance. By carrying out legal consultation, carrying out legal publicity, resolving and mediating contradictions, and participating in social governance, community legal consultants in Wuhan meet the legal service needs of social community governance and serve the high-quality development of urban economy and society. There are still some problems, such as uneven distribution of legal consultation quantity, relatively single legal publicity mode, slightly simple ways and methods to resolve contradictions, and insufficient motivation to participate in social governance.The main reasons are as follows: Community legal counsel system popularity and utilization should be improved, basic resources supply capacity is insufficient, evaluation mechanism is imperfect, the work ethicand the way should be innovative. The Optimal paths of enhancing residents’ participation and utilization, strengthening grass-roots resources supply capacity, improving the comprehensive evaluation mechanism, the innovation community legal adviser work idea have been proposed.
