农民专业合作社强制退出机制的审视与完善

Survey and Improvement of the Compulsory Withdrawal Mechanism of Farmers’Professional Cooperatives

农民专业合作社监管分为内外两部分,在内部监督不能充分发挥作用的情况下,应加强外部监督,健全强制退出机制。对于农民专业合作社强制退出机制存在的现行法律规定模糊、政策重支持轻监管、各地规定简单零散等问题,文章认为应在内容层面关注合作社强制退出的情形,在立法层面为退出机制提供依据,在执法层面明确部门落实职责。

The supervision of farmers’professional cooperatives is divided into internal and external parts.In the case that the internal supervision cannot fully play its role,the external supervision should be strengthened,and the compulsory withdrawal mechanism should be improved.With regard to the existing problems of the compulsory withdrawal mechanism,such as the vague legal provisions,the policy emphasis on support over supervision,and the simple and scattered local regulations,the study believes that we should pay attention to the situation of the compulsory withdrawal of cooperatives at the content level,provide the basis for the withdrawal mechanism at the legislative level,and clarify the responsibilities of departments at the law enforcement level.
