高龄劳动者工伤保险制度的规范设计——以浙江、广东、江苏三省试点文件为切入点

Designing Industrial Injury Insurance System for Eldly Workers in a Comprehensive Way——a research with policies piloted in Zhejiang,Guangdong and Jiangsu Provinces as its starting point

我国高龄人口的绝对数量和劳动参与率呈现上升趋势,因此工伤保险制度需要完善。高龄劳动者工伤保险制度的体系构造,需重点从主体范围、参保原则、待遇标准、资金筹集、与其他保险的衔接等五个方面进行规则设计。完善高龄劳动者工伤保险制度的最优路径是采用主辅模式,即以工伤保险为主、以商业性保险为辅;完善高龄劳动者工伤保险制度的次优路径是采用替代模式,即选择性参加工伤保险或者商业保险。

While both eldly workers and labor participation rate are rising in China,there is lack of legal rules and regulations governing the industrial injury insurance system for eldly workers.To design the industrial injury insurance system covering the eldly workers,the following five aspects should be considered:the scope of covered participants,the insurance participation principles,the level of compensation,the fund raising channels and the connectivity with other kinds of insurance schemes.The best way of improving the industrial injury insurance system for eldly workers is to adopt a model with industrial injury insurance as the main body supplemented by commercial insurance.Another way of improving the system is to adopt an alternative model,that is to choose either the industrial injury insurance or a commercial insurance.
