检察院提起环境民事公益诉讼的反思与展望

Reflections and prospects on procuratorates initiating environmental civil public interest litigation

如今检察机关提起环境公益诉讼迅速发展,但是存在检察机关调查取证制度有待完善,社会组织的诉权实现难度较大等问题,这表明检察机关对环境提起公益诉讼的现状仍有改善的紧迫性。因此,本文针对存在现状进行分析并提出完善建议。

Environmental public interest litigation by procuratorial organs has developed rapidly. However, the investigation and evidence collection system of the procuratorial organs needs to be improved, and the realization of the litigation right of social organizations is difficult, which indicates that there is still an urgent need to improve the current situation of procuratorial organs in filing environmental public interest litigation. Therefore, this paper analyzes the existing situation and puts forward suggestions for improvement.
