2021年新修订版专利法关于产品外观设计专利的内容有较大的完善和补充,进一步激发和保护设计师进行产品设计创作的知识产权和设计创新性。文章通过对具体案例产品申请产品外观设计专利的实践过程的分析与总结,为设计师从事产品外观设计创作提供了创作思路,探讨了申请产品外观设计专利实践过程中的产品设计的设计特点和方法,以及新版专利法中关于产品外观设计部分新增修改和重要完善的内容。设计师通过借助产品外观设计专利申请的规则和手段进行产品设计和创作具有重要的实践意义。

The newly revised Patent Law in 2021 has greatly improved and supplemented the content of product design patents,so as to further stimulate and protect the intellectual property rights and design innovation of designers in product design and creation.Through the analysis and summary of the practical process of applying for product design patent for specific case products,this paper provides creative ideas for designers to engage in product design creation,discusses the design characteristics and methods of product design in the practical process of applying for product design patent,as well as the newly added,modified and important improved contents of product design in the new patent law.It is of great practical significance for designers to design and create products by using the rules and means of product design patent application.
