长江流域生态保护与高质量发展法治保障的实证研究——以芜湖市为例

An Empirical Study on Legal Guarantee for the Ecological Protection and High Quality Development in the Yangtze River Basin——Taking Wuhu City as an Example

对长江流域生态保护与高质量发展实施法治保障,应当坚持五个基本原则。通过对以芜湖市为中心的法治保障长江流域生态保护与高质量发展的实证考察,当前仍存在社会公众对法治保障工作意识不足、缺乏《长江保护法》具体实施细则等六个突出问题。对此提出六大措施机制,分别是全面提升社会公众法治保障的意识水平;以长江流域各省、市立法机关为主体,出台《长江保护法》实施细则;将预防危害长江生态保护违法犯罪成为全社会共识;加强长江流域建设规划立法、执法;加大法治保障创新驱动,推进长江流域产转型升级;不断拓展生态价值转化,推进长江流域绿色发展。确保法治保障长江流域生态保护与高质量发展得到切实实施。

To implement the legal guarantee for the ecological protection and high-quality development of the Yangtze River Basin,it should adhere to five basic principle.Based on an empirical investigation centered on Wuhu City,there are still six prominent problems,such as insufficient public awareness of the legal guarantee work and the lack of specific implementation rules of the Yangtze River Protection Law,etc..In this regard, six major measures and mechanisms are proposed, namely, to comprehensively enhance the public’s awareness of the legal guarantee;to promulgate the implementation rules of the Yangtze River Protection Law, with the provincial and municipal legislatures of the Yangtze River basin as the main body;to improve the consensus of the whole society of the prevention of violations and crimes that endanger the ecological protection of the Yangtze River;to strengthen the legislation and law enforcement of the Yangtze River basin;to increase the legal guarantee and innovation-driven,and promote the transformation and upgrading of the Yangtze River basin;to continuously expand the transformation of ecological value and promote the green development of the Yangtze River Basin,so as to ensure that the legal guarantees of ecological protection and high-quality development in the Yangtze River basin are effectively implemented.
