The Legal Thinking of Motor Vehicle’s Not Yielding the Right-of-way to Pedestrians

礼让行人是现代社会文明安全驾驶的基本要求。交警查处不礼让行人时应充分考虑路面通行中的特殊情况,违法仅指能让而不让的驾驶人,不应忽视客观上未能及时发觉且无法避让等特殊情形。《行政处罚法》的修订要求非现场处罚程序中的数据采集环节必须重视技术审查和法制审查两个方面的问题,做好相对人的申诉原因和异议理由的答复工作。

Yielding the right-of-way to pedestrians is the basic requirement of civilized safe driving in modern society. Traffic police should give full consideration to the special circumstances in the road when dealing with cases of not yielding to pedestrians. Illegal act only refers to the drivers who can give way but do not give way,while the special circumstances such as objectively failing to detect in time and being unable to avoid giving way should not be ignored. The revised Administrative Punishment Law requires that the data collection process of off-site punishment procedure must pay attention to the technical review and legal review,and do a good job of replying to the counterparty’s reasons for complaint and objection.
