我国数字经济治理体系现代化的制约因素及实现路径

Restrictive Factors and Realization Path of Modernization of Digital Economic Governance System in China

数字经济治理体系是在多元主体参与下促进数字经济健康发展的制度体系,包括数据信息、数字平台、网络生态等各领域体制机制和法律法规安排,贯穿后台数据信息汇集、中端数字平台监管、前端网络生态共治三个关键环节。我国采取了一系列措施推进数据治理、市场治理、生态治理,但是数字经济治理体系现代化仍面临立法完备性不足和技术水平不高、行为界定困难和事后执法失效、管辖边界不清和主体参与度低等诸多制约因素。为推进我国数字经济治理体系的现代化、促进我国数字经济向好发展,应健全数字经济法治体系、提升智慧监管水平,科学判定垄断行为、强化平台事前监管,明确多元主体权责、推动多方深度参与。

The digital economy governance system is an institutional system that promotes the healthy development of the digital economy with the participation of multiple entities,including institutional mechanisms and legal and regulatory arrangements in various fields such as data information,digital platforms,and network ecology.It runs through the three main links of background data information collection,middleend digital platform supervision,and front-end network ecological co-governance.China has adopted a series of measures to promote data governance,market governance,and ecological governance.However,the modernization of the digital economy governance system still faces many constraints,such as insufficient legislative completeness and low technical level,difficulty in defining behavior and post-law enforcement failure,unclear jurisdictional boundaries,and low subject participation.In order to promote the modernization of China’s digital economy governance system and governance capacity,and promote the sound development of China’s digital economy,we should improve the legal system of the digital economy and enhance the level of intelligent supervision;determine the monopoly behavior scientifically and strengthen the platform prior supervision;clarify the rights and responsibilities of multiple subjects and promote multi-party deep participation.
