摘要
我国在对学前儿童游戏权的政策表达中呈现出主体上多元性与单一性并存、目标上受教育权与发展权相统一、内容上突出提供权与受保护权、方式上政策工具的选择呈现多样性的特点。但同时也暴露了多元主体参与权利保障缺位、政策保障内容体系不健全、政策工具使用不均衡、政策执行环境不优等问题。优化学前儿童游戏权政策保障的路径在于激发多元主体参与权利保障,打造良好的政策执行环境;明确儿童游戏权保障的内容,健全政策保障的内容体系;加强游戏权的立法工作,提升政策工具使用的均衡性和有效性。
In the policy expression of preschool children’s right to play,China presents the following characteristics:the coexistence of pluralism and oneness in subjects,the integration of the right to education with that of development in objectives,the highlighting of the right to provide and the right to be protected in contents as well as the diversity of the choice of policy in tools.But at the same time,it also exposes the following problems:a lack of multi-subject participation in right guarantee,the imperfect content system of policy guarantee,the imbalanced use of policy tools and the unfavourable policy implementation environment.The way to optimize the policy protection of preschool children’s right to play lies in stimulating multiple subjects to participate in the right protection,creating a good policy implementation environment,clarifying the protection content of the right to play,perfecting the content system of the policy protection,strengthening the legislation of the right to play,and improving the balance and effectiveness of the use of policy tools.
