On the Legal Protection of Geographical Indications

目前,我国地理标志虽然在国际交流合作、法律法规建设等方面取得了一定的成就,但是仍面临地理标志专门法不完善、地理标志重复保护现象严重、地理标志名称不统一、地理标志保护所依据的法律位阶失调等问题。在知识产权强国建设背景下,需要采取制定专门的《地理标志法》、禁止地理标志重复保护、统一地理标志名称以及完善地理标志保护协调机制的措施,以期创新性地解决历史遗留问题,推动我国经济高质量发展。

Although China’s geographical indications have made certain achievements in international exchange and cooperation, and in the construction of laws and regulations, there are still problems such as imperfect specialized laws, serious duplication of protection, non-uniform names, and imbalance in the legal order of the protection basis. In the context of the construction of a powerful intellectual property nation, some measures should be taken including formulating a specialized Law on Geographical Indications, prohibiting repeated protection, unifying indication names and improving protection coordination mechanism in order to solve the problems left over by history in an innovative way and promote high-quality economic development.
