论《民法典》中的疫情条款

On the “Epidemic Situation Clause” in Civil Code

新型冠状病毒疫情在全球范围内广泛传播,对社会生活秩序造成重大影响。2020年5月28日,《民法典》在新型冠状病毒疫情传播期间颁布,颁布时期的特殊性导致部分条款携带疫情因子。疫情条款的紧急入典完善了突发公共卫生事件治理体系,为疫情防控提供了法治指南,但是部分疫情条款的合理性尚存在进一步磋商的空间。

The novel Coronavirus pandemic has spread widely around the world, causing a major impact on social life. On 28 May 2020, the Civil Code was enacted with the Epidemic Situation Clause,which improves the management system of public health emergencies and provides legal guidance for epidemic prevention and control, but the rationality of some epidemic provisions needs further consultation.
