摘要
在民事执行实践中,关于住房公积金能否作为执行责任财产始终存在着争议,但现行法律对此并无明示。基于对住房公积金的性质、功能、规范位阶、实施效果、法律价值判断等因素的综合考量,关于住房公积金的可执行性,有否定说、肯定说和附条件执行说三种观点。住房公积金强制执行的地方实践中,逐步形成了限定执行模式、扩大执行模式和自由裁量模式三种执行模式,并呈现出不同的价值判断、执行范围和执行规范。三种执行模式中,扩大执行模式更符合住房公积金强制执行的法律理念和社会现实,但也存在着执行范围不统一、执行方式不明确等弊端。住房公积金的强制执行需厘清执行原则,统一执行规范,界定可执行范围,明确执行方式,以解决住房公积金强制执行中的弊病,实现住房公积金强制执行法律效果与社会效果的统一。
In the practice of compulsory execution in civil affairs,there is always a dispute about whether the housing provident fund can be used as the liability property for compulsory execution.However,there is no clear regulation in current laws.Based on the comprehensive consideration of the nature,functions,standard level,implementation effect,and legal value judgment of the housing provident fund,there are three viewpoints on the feasibility of the housing provident fund:negation,affirmation,and conditional execution.In the local practice of mandatory execution of housing provident funds,three execution modes are formed:limited execution mode,extended execution mode,and discretionary mode,which show different value judgment,implementation scope and implementation specifications.Among the three execution modes,expanding the execution mode is more in line with the legal concept and social reality of mandatory execution of the housing provident fund.However,there are also problems such as inconsistent scope of execution and unclear execution methods.Therefore,the enforcement principles,the executable scope and the implementation mode of the housing provident fund shall be clarified and defined,so as to solve the disadvantages of the mandatory implementation of the housing provident fund,and to achieve the unity of the legal and social effects of the mandatory implementation of the housing provident fund.
