信息化时代的发展凸显出对公民个人信息保护的必要性和紧迫性。刑事司法领域中的大数据侦查有个人信息保护的实际需求。侦查机关肩负着发现案件线索、打击犯罪的使命,以国家强制力为后盾,侦查行为极易侵犯到公民的个人信息权益。大数据技术的引入将相关技术侦查措施变成侦查机关侦破各类案件的强有力武器,同时数据收集、分析、共享的过程也给个人信息保护带来严重威胁。为保障被侦查人的信息不受侵犯、遏制侦查机关信息处理权的不断扩张、促进刑事诉讼法律规范体系不断健全,在检视国内外个人信息保护相关法律规范的基础上,提出严格遵循比例原则、以主体赋权和权力规制为进路,加快大数据侦查中个人信息保护体系的建构进程。

The development of the information age highlights the necessity and urgency of the protection of citizens’ personal information. Big data investigation in the field of criminal justice has the actual demand of personal information protection. Investigation organs shoulder the mission of finding clues in cases and cracking down on crimes. With the support of the state’s coercive force, investigation is liable to infringe upon citizens’ rights and interests of personal information. The introduction of big data technology has turned relevant technical investigation measures into powerful weapons for investigation organs to solve various cases. Meanwhile, the process of data collection, analysis and sharing has also brought serious threats to personal information protection. In order to protect the information of the investigated from infringement,curb the continuous expansion of the information processing right of the investigation organs, and promote the continuous improvement of the legal norms system of criminal procedure, on the basis of reviewing the relevant laws and norms of personal information protection at home and abroad, this paper proposes to strictly follow the principle of proportionality, take the subject empowerment and power regulation as the approach, and accelerate the construction process of the personal information protection system in the big data investigation.
