摘要
农用地,特别是农用地中的耕地关乎国家的粮食安全、生态安全,我国严格限制农用地转为建设用地,控制建设用地总量,对耕地实行特殊保护。2022年4月15起在建设用地报批时,现状为建设用地的,若无合法来源,应按照建设占用时的国土变更调查的实际地类报批,即对现状的建设用地进行追溯,但在此过程中如何计算各地类的面积,尚没有明确。本文先简述了建设用地追溯流程,再对建设用地追溯中计算面积时遇到的问题进行了分析,最后提出了两种地类面积计算方法,比较了两种方法的优劣,并进行了推荐。
Agricultural land,especially cultivated land in agricultural land,is related to national food security and ecological security.China strictly restricts the conversion of agricultural land to construction land,controls the total amount of construction land,and implements special protection for cultivated land.When applying for approval of construction land since April 15,2022,if there is no legal source for the current construction land,it should be submitted for approval according to the actual land category of the land change survey at the time of construction occupation,that is,the current construction land should be traced.However,it is not clear how to calculate the area of each category in this process.This paper first describes the process of construction land tracing,then analyzes the problems encountered in calculating the area of construction land tracing,and finally proposes two methods for calculating the area of land types,compares the advantages and disadvantages of the two methods,and makes recommendations.
