摘要
近年来,随着我国《民法典》的颁布实施,经济法、行政法、环境法和社会法等部门法的法典化研究日益受到各界的重视。百余年来,在中国共产党的领导下,我国劳动立法积累了丰富的历史经验,其中“让人民当家做主”“以人民为中心”“保护最广大劳动者权益”等是变中不变、一以贯之的核心理念。当前我国人口规模依然巨大,叠加人工智能技术崛起、数字经济、新就业形态、零工经济勃兴与去劳动关系化局面等复杂情形,已经与《劳动法》等法律法规制定的时代背景相距甚远,该如何面对是值得深思的重大议题。自1995年《劳动法》正式实施,经历了近30年的劳动法治现代化历程之后,我国劳动法治不断完善,为编纂劳动法典提供了历史经验和现实基础,编纂劳动法典的条件日益成熟。
In recent years,with the promulgation and implementation of China's Civil Code,research on codification in the field of economic law,social law and other sectoral laws has received increasing attention from relevant parties.In the past 100 years,the Communist Party of China has led the people to continuously achieve great success in the cause of revolution and socialist construction,and has accumulated rich historical experience in the field of labor legislation.Review the Party's century-long history of revolutionary struggle and development,the times have changed,and the concepts of"change"and"no change","the people being the masters of the country"and"people-centered",have been the same and consistent.The issue of formulating a labor code is a serious issue worthy of consideration,as it is far removed from the background of the Labor Law and other laws and regulations,and faces the complex situation of the rise of artificial intelligence technology,the digital economy,new employment patterns,the emergence of the casual labor economy and the overlapping situation of de-labor relations.After nearly 30 years of labor legalization,the labor law system has been continuously improved.The compilation of the Labor Code must highly match the historical experience with the development of the times,and truly reflect the modernization of labor legalization with socialism of Chinese characteristics.
