Research on Procuratorial Integration

作为我国检察制度改革的重要成果之一,检察一体化的工作机制已经初步确立。在我国的司法体制背景下,检察一体化具有“组织一体化”和“业务一体化”的基本要求,在构造上形成了“纵向一体化”与“横向一体化”并存的基本格局。实行检察一体化,有助于实现检察资源的有机整合,推动检察机关办案职能与监督职能的有效衔接,有利于强化检察机关内部的监督制约机制。通过总结我国检察制度改革的成果,借鉴域外国家推行检察一体化的经验,可以从规范上下级检察机关上令下从关系、完善异地调用检察官制度的角度出发,强化纵向一体化的工作机制,同时,还可以从加强刑事检察一体化、公益诉讼一体化、融合“四大检察”职能、推动跨区域检察协作等方面,探索横向一体化的制度框架。

As one of the important achievements procuratorial system reform in China, the working mechanism of procuratorial integration has been preliminarily established. Under the background of judicial system in China, procuratorial integration has the basic requirements of “integration of organization” and “integration of prosecutorial affairs”, and has formed a basic pattern in which “vertical integration” and “horizontal integration” coexist. The implementation of procuratorial integration will help to realize the organic integration of procuratorial resources, promote the effective connection of the case-handling functions and supervision functions, and help strengthen the internal supervision and restriction mechanism of the procuratorate. By summarizing the achievements of the reform of the procuratorial system in our country and drawing on the experience of foreign countries in promoting procuratorial integration, we can strengthen the working mechanism of vertical integration from the perspective of regulating the relationship between superior and subordinate procuratorial organs and improving the system of calling procurators in different places. At the same time, it is also possible to explore the institutional framework of horizontal integration in terms of strengthening the integration of criminal prosecution, the integration of public interest litigation, the integration of the functions of the “four major prosecutors”, and the promotion of cross-regional prosecutorial cooperation.
