论李大钊的马克思主义法学观

On Li Dazhao’s View of Marxist Law

李大钊运用历史唯物主义基本原理考察法律现象,反对封建帝制思想,吸收西方法治文化的精华,从中国历史和现实的实际出发,建构富有启发意义的马克思主义法学思想,促进了中国革命的发展。李大钊主张吸收国外先进的法治理念,把法治理论和法治实践有机结合起来,利用人民群众的力量进行法治建设,发挥法律约束作用,建立庶民的法律,保障人民群众的根本利益和基本权利。李大钊的马克思主义法学观对于中国特色社会主义法治建设、运用法治方法解决中国现实问题以及实行社会主义协商民主都具有积极意义。

Li Dazhao used the basic principles of historical materialism to investigate legal phenomena,opposed the feudal monarchy,absorbed the essence of the western legal culture,and started from the reality of Chinese history and reality to construct inspiring Marxist legal thought,which promoted the development of the Chinese revolution.Li Dazhao advocated absorbing the advanced concept of rule of law from abroad,organically combining the theory of rule of law with the practice of rule of law,using the power of the people to carry out the construction of rule of law,giving full play to the role of legal restraint,establishing laws for the common people,and safeguarding the fundamental interests and rights of the people.Li Dazhao’s Marxist view of law is of positive significance to the construction of the rule of law in socialism with Chinese characteristics.And it is crucial to the use of the rule of law to solve China’s practical problems and the implementation of socialist consultative democracy.
