Vlog Short Video Copyright Infringement and Governance

【目的】具有一定时长的Vlog可构成我国著作权法保护的电影作品、电视剧作品之外的视听作品。治理侵权是Vlog产业发展亟待解决的问题。【方法】通过分析梳理Vlog侵权泛滥的原因,揭示侵权治理之途径。【结果】当前Vlog产业发展中存在民众普遍缺乏知识产权观念、Vlog独创性认定困难、网络平台逃避责任、短视频算法窘境和著作权法存在盲区等问题。【结论】治理Vlog侵权需要提高全民著作权保护意识、强化平台注意义务和监管、优化算法营造正向短视频环境、明确Vlog独创性认定标准、完善“避风港”规则、转变司法理念等多措并举。

[Purposes]Vlog with a certain length can constitute audio-visual works other than film works and TV series protected by China's copyright law.Controlling infringement is an urgent problem to be solved in the development of Vlog industry.[Methods]Reveal the way of infringement governance by analyzing and sorting out the reasons for the prevalence of Vlog infringement.[Findings]Difficulties were found,such as the general lack of intellectual property awareness among the people,difficulties in the originality of Vlog recognition,the evasion of responsibility of network platforms,the dilemma of short video algorithms and the grey area of copyright.[Conclusions]To deal with Vlog infringement,it is necessary to improve the people's awareness of copyright protection,strengthen the platform's duty and supervision,improve algorithms to create a positive short video environment,clarify the Vlog original rec⁃ognition standards,improve the"safe harbors"principle.In addition,Judicial personnel should change their concept and take multiple measures to protect the copyright.
