我国能源数据安全法律规制研究

Research on the Legal Regulation of China’s Energy Data Security

随着大数据技术的发展,能源数据规模及数据运用能力逐步成为我国能源运行体系的重要组成部分,对数据的占有、控制、共享与开发成为制定“碳中和”等能源政策的重要基础。建立能源数据安全法律制度有利于保护国家能源体系的安全,助力“碳中和”目标的实现,规范能源数据的合理使用。在分类分级原则指导下,根据能源数据特点,建立能源数据管理秩序,依据自决权限制理论扫清内部安全管控的私权障碍,在公共利益信托理论的支持下强化外部安全监管力度。在内外理论的指导下构建包括能源数据分类分级、内部数据安全管控和外部数据安全监管的法律制度。

With the development of big data technology,the scale of energy data and the ability of data application have gradually become a significant part of China’s energy operation system.The possession,control,sharing and development of data have become an important basis for formulating energy policies such as“Carbon Neutral”.The establishment of a legal system for energy data security is conducive to protecting the security of the national energy system,helping to achieve the goal of“carbon neutrality”and standardize the rational use of energy data.Under the guidance of the principle of classification and classification,the energy data management order should be established according to the characteristics of energy data,the private rights barriers of internal security control should be removed according to the theory of limitation of self-determination,and the external security supervision should be strengthened under the support of the public interest trust theory.Under the guidance of internal and external theories,we can establish legal protection measures including energy data classification,internal data security control and external data security supervision.
