A Research on the Legal System Construction of“Forging the Consciousness of Community for the Chinese Nation”:History,Text and Future

“铸牢中华民族共同体意识”嵌入立法是推动我国新时代民族工作的重要手段。通过对“铸牢中华民族共同体意识”嵌入立法的历史和文本的实证分析,我国基本形成了党内法规体系、中央法规体系与地方性法规体系“三轨并行、功能互补”的法规体系,但仍存在中央法规建设顶层设计不足、地方性法规建设形式化问题突出以及各地方对“铸牢中华民族共同体意识”嵌入立法的认识不统一等问题。未来法制建设发展方向将主要集中在:如何加强“中华民族共同体”建设、如何充分发挥地方性法规的具体措施规范功能以及如何加强各民族共同性建设,推动《中华民族共同体建设法》单行立法。

Forging the consciousness of community for the Chinese nation into the law is an important means to promote China’s ethnic work in the new era. Through the empirical analysis of the history and text of forging the consciousness of community for the Chinese nation, it can be found that China has basically formed a legal system of inner-party legal system, local legal system and central legal system, but there are still some problems, such as the insufficient construction of the top-level design of central legal system, the prominent formalization of local legal system construction, and disunified understanding of forging the consciousness of community for the Chinese nation into the law in various places.Therefore, we should focus on intensifying the construction of the sense of community for the Chinese nation, giving full play to the specific measures of local laws and regulations, strenthening the common construction of all ethnic groups, and promoting the separate legislation of law of the construction of community for the Chinese nation.
