大数据时代个人信息保护的困境与有效进路

Research on the Dilemma of Personal Information Protection in the Age of Big Data and Its Solution

随着互联网技术的与日俱进,互联网信息在国家治理,社会管理等方面发挥了重要作用。然而个人信息的不当利用有可能侵犯权利主体的隐私和其他数据利益,因此加强对公民个人信息的保护具有紧迫性与必要性。本文认为,目前大数据的存在削弱了知情同意原则效力,个人信息保护处于行政监管效果不佳、权利救济不力的困境。因此,在《中华人民共和国个人信息保护法》出台后,应逐步弥补现有体系的不足,加强行业自律,创新监管方式,完善救济体系,以实现对个人信息的有效保护。

With the advancement of Internet technology,Internet information has played a significant role in national governance and social management.However,improper use of personal information may violate the privacy and other data interests of right subjects,hence,it is urgent and necessary to strengthen the protection of personal information.This paper argues that the emergence of big data has weakened the effectiveness of the principle of informed consent,thus,personal information protection faces the dilemma of ineffective administrative supervision and ineffective rights relief.Therefore,after the introduction of the Law of the People’s Republic of China on the Protection of Personal Information,relevant departments should strive to make up for the shortcomings of the existing system,strengthen industry self-regulation,innovate regulatory approach,and improve the relief system in order to effectively protect personal information.
