论大数据时代的行政法精神

The Spirit of Administrative Law in the Era of Big Data

随着大数据时代的到来,形成了数据理性对行政法的多维度渗入,使得行政法的经济背景、社会背景、文化背景和法治背景都呈现出数字化趋向,由此改换了行政法存在的主客观基础、价值目标和运作机制,促使行政法精神必将进入一个全新的历史阶段,为此行政法必须作出积极回应。认为:行政法治信息支撑、行政法模式化、行政裁量算法运用、行政行为标准化等是主要应对措施;同时,必须从整体上对大数据时代行政法的趋势有个判断,即行政法去经验主义、数字构型、机械化操作、技术治理等应当是其基本走向。

As the forthcoming of the big data era, the multidimensional permeation of data rationality into the administrative law is formed, leading to the digital trend of administrative law under economic,social, cultural and legal backgrounds. Therefore, the subjective and objective basics, value object and operation mechanism of the existence of administrative law are changed, making the spirit of administrative law inevitably enter a brand-new historical stage, for which the administrative law needs to make positive responses. In our opinion, the dominating responsive measures should be the information support of rule of administrative law, the modeling of administrative law, the arithmetic application of administrative discretion, the standardization of the administrative act, and so on. Meanwhile, it is necessary to make a judgment by and large on the trend of the administrative law in the big data era, and to treat the deempiricism of administrative law, digital construction, mechanical operation, and technical governance as the basic tendency.
