Interpretation of the Marrakesh Treaty Based on Hegel's Philosophy of Law

作为版权领域明确使用人权话语的国际知识产权条约,《马拉喀什条约》的订立与实施旨在保障阅读障碍者对无障碍格式版作品的获取,真正享有阅读权、受教育权、发展权、经济文化社会生活的权利等基本人权。“人”是黑格尔哲学理论体系的根基。借助黑格尔关于“人”的研究,以自由意志的实现过程去解读版权法的立法精神,不仅有助于版权法设权与限制的正当性证成,还有助于残障观念的革新,认识到残障是人类常态和多样性的一部分,亦是人类生命普遍存在的局限性。黑格尔对“人”的特殊性、差异性、高贵性认识,有利于《马拉喀什条约》的条文解释和平等、自由观念的推广,重塑以人为本的版权保护理念。

As an international intellectual property treaty that explicitly uses human rights discourse in the field of copyright,the Marrakesh Treaty was established and implemented to ensure access to accessible formats for people who are blind,visually impaired or otherwise print disabled,so that they can truly enjoy their basic human rights,such as the right to read,the right to education,the right to development,and the right to economic,cultural,and social life."Human"is the foundation of Hegel's philosophical system.Drawing on Hegel's study of"human",the legislative spirit of copyright law is interpreted in the light of the process of realizing free will,which not only helps to justify the creation of rights and restrictions of rights in copyright law,but also helps to innovate the concept of disability,recognizing that disability is part of the normality and diversity of human beings,as well as the limitations of human life in general.Hegel's understanding of the particularity,difference,and nobility of human beings is conducive to the interpretation of the provisions of the Marrakesh Treaty and the promotion of the concepts of equality and freedom,as well as the reshaping of the concept of human-centered copyright protection.
