单身女性进行社会性冻卵的正当性分析与实现路径

On the Justification of Allowing Single Women Access to Social Egg Freezing and Its Approach

社会性冻卵是保有女性未来生育可能性、保护女性平等生育权的重要途径。我国目前在部门规章中规定禁止单身女性使用人类辅助生殖技术进行冻卵,这种规定罔顾社会实践的客观需求。目前国内反对单身女性社会性冻卵的三点主要考量因素并不是真正的障碍,向单身女性开放社会性冻卵是合法且合理的。在我国向单身女性开放冻卵技术,可以将“冻卵”与“生殖”分离看待,以解决伦理问题,取消现有的禁止性规范并建立严格的登记制度和知情同意制度,以防范负面风险。

Socially-oriented egg freezing technology is an important way to maintain the possibility of women’s future fertility and protect women’s equal reproductive rights.China has stipulated in relevant department regulations that unmarried women are prohibited from using assisted reproductive technology to freeze eggs,but this provision ignores the objective needs of the society.At present,the three main considerations against unmarried woman using social egg freezing are not reasonable.We can allow single woman to use egg freezing by separating“reproduction”from“egg freezing”to solve potential ethical problems.Meanwhile,negative risks should also be prevented forestalled by canceling existing prohibitive norms,establishing a strict registration system,and putting in place a sound informed consent system.
