体育媒体服务的法律保护困境及规范路径研究

Research on the Predicament of Legal Protection of Sports Media Service And the Way of Standardization

体育媒体服务的结构调整是体育立法改革的核心问题,根本目的在于保障公众通过媒体实现对体育事业改革的有效监督的同时为媒体发展提供法律支持。主要采用综合分析法、对比例证法等研究方法,从体育媒体公共服务属性角度出发,研究权利保护理论,对于体育媒体服务的结构重塑与规范路径均具有重要意义。研究结果表明:体育媒体服务的公共治理是一个系统工程,体育媒体活动必然也是必须纳入法治的轨道。必须兼顾体育媒体产权的立法保护、体育媒体服务的法律规制、体育媒体从业者法律保护等多个方面。同时,体育立法应为体育新闻供给提供法律边界,制定体育传媒领域具体业务规定和条例,以及明确体育媒体权利结构与其他权利之间的界限,来实现体育媒体监管与其他权利的良性互动。

The structural adjustment of sports media service is the core issue of sports legislation reform,the basic aim is to guarantee the public to realize the effective supervision of sports cause reform through the media,and at the same time to provide legal support for the development of the media.This paper mainly adopts the methods of comprehensive analysis and comparative proof to study the theory of rights protection from the perspective of the public service attributes of sports media,it is of great significance to reshape the structure and standardize the path of sports media service.The results show that the public governance of Sports Media Services is a systems engineering,and sports media activities must be brought into the orbit of rule of law.It is necessary to take into account the legislative protection of sports media property rights,the legal regulation of sports media services and the legal protection of sports media practitioners.At the same time,sports legislation should provide a legal boundary for the provision of sports news,establish specific operational provisions and regulations in the field of sports media,and clarify the boundary between the rights structure of sports media and other rights,to realize the benign interaction between sports media supervision and other rights.
