新时代我国纪检监察工作中人权保障的思考

Thoughts on Protection of Human Rights in China’s Discipline Inspection and Supervision Work in the New Era

新时代对我国纪检监察工作中人权保障工作提出了新的要求。结合《中华人民共和国监察法》等相关的党纪法规,本文对新时代我国纪检监察工作中人权保障的落实,提出了三条路径:保障被调查人基本权利,要规定证据收集手段应合规合法、对讯问和重要取证全程录音录像、严格涉案财物的处理;注重人文关怀,要秉持治病救人的审查调查理念、谈话讯问工作要尊重人格尊严、外查取证要保障被调查对象合法权益;坚持人道主义,要保障被调查人的救济性权利、保护被调查人的隐私和安全。

The new era has put forward new requirements for the human rights protection of China’s discipline inspection and supervision work. In combination with the Supervision Law of the People’s Republic of China and other relevant Party discipline laws and regulations, this paper proposes three paths to the implementation of the general human rights protection of discipline inspection and supervision in the new era: to protect basic personnel,to specify that the means of evidence collection should be legal and compliant, to record and video the whole process of interrogation and important evidence collection, and to strictly handle the property involved in the case;We should pay attention to humanistic care, adhere to the concept of review and investigation of curing the disease and saving the people, respect the dignity of human dignity in the work of conversation and interrogation,and protect the legitimate rights and interests of the investigated objects through external investigation and evidence collection;Adhere to humanitarianism, ensure the relief rights of the investigated, and protect the privacy and security of the investigated.
