在线诉讼电子化材料司法适用问题与完善路径

The Judicial Application of Electronic Materials in Online Litigation and Its Improvement Path

2021年《人民法院在线诉讼规则》(以下简称《在线诉讼规则》)颁布施行,标志在线诉讼时代的来临,《在线诉讼规则》明确除特殊情况外,在线诉讼案件无须提交纸质材料,电子化成为在线诉讼材料主要呈现形式。通过对在线诉讼电子化材料进行概念界定,分析在线诉讼电子化材料司法适用中存在的认证程序繁琐、数据管理风险、示证难以触达等问题,有针对性地提出通过优化电子化材料认定规则、加强电子化材料数据管理、实现电子化材料算法透明、引入区块链技术与电子化材料相结合等方式对问题予以回应,为完善在线诉讼电子化材料司法适用提出可行方案。

The promulgation and implementation of Online Litigation Rules of People's Courts in 2021 marks the advent of the era of online litigation.It is clear that,except in special circumstances,online litigation cases do not need to submit paper materials,and electronic filing has become the main form of online litigation materials.By defining the concept of online electronic litigation materials,this paper analyzes the problems existing in the judicial application of online electronic litigation materials,such as cumbersome authentication procedures,data management risks,and difficult access to evidence.In order to improve the judicial application of electronic litigation materials,this paper proposes to respond to the problems by optimizing the identification rules of electronic materials,strengthening the data management of electronic materials,realizing the transparency of electronic materials algorithm,and introducing block chain technology to combine electronic materials.
