摘要
《公共图书馆法》第41条明确了公共图书馆应当加强古籍保护,推进古籍整理、出版和利用,然而未对古籍点校成果的保护与利用作出清晰的规定,亟需通过修改《公共图书馆法》《著作权法》并制定《古籍保护条例》,规定古籍点校成果构成作品的条件,通过赋予点校者著作权或邻接权等方式加强对古籍点校创新成果的保护,明确公共图书馆在古籍点校工作中应发挥的作用,建立起以著作权形式保护古籍点校成果的有效路径。
Article 41 of the Public Library Law specifies that public libraries should strengthen the protection of ancient books and promote the collation, publication and utilization of ancient books. However, how to protect and utilize the ancient books proofreading achievements has not been made more clear, so it is urgent to amend the Public Library Law and the Copyright Law in time, and formulate the Regulations on the Protection of Ancient Books, to stipulate the conditions for the ancient books proofreading achievements to constitute works, and to endow them with copyright or neighboring rights to strengthen the protection of the ancient books proofreading innovation achievements. It is necessary to clarify the role of public libraries in ancient books proofreading, and establish an effective way to protect the ancient books proofreading achievements in the form of copyright.
