摘要
雇主责任保险是用人单位用于转嫁企业用工风险,维护和保障企业正常经营活动的一种责任保险。本文通过分析雇主责任保险案件审理中常见的争议点,确立审理此类案件要始终坚持财产保险的损失补偿原则,充分补偿被保险人的实际损失,以平衡保险人与被保险人合法利益,实现保险产品分散风险的设计初衷;同时为防止被保险人攫取超额收益,从源头上减少纠纷的发生,需要保险公司优化管理制度和条款设计,用工企业增强法律意识,监管主体加强协作化解纠纷。
Employer’s liability insurance is a kind of liability insurance used by employers to transfer the employment risks of enterprises, maintain and protect the normal business activities of enterprises. By analyzing the common controversial points in the trial of employer’s liability insurance cases, the principle of loss compensation of the property insurance shall always be adhered to in the trial in this essay. The actual losses of the insured shall be fully compensated in order to balance the legitimate interests of insurers and insured and achieve the original design intention of insurance products to disperse risks. Meanwhile in order to prevent the insured from capturing excessive income and reduce the occurrence of disputes from the source, insurance companies shall optimize the management system and the clause, and employers shall enhance their legal awareness and various regulators shall strengthen joint efforts to collaborate to resolve disputes.
