刑事附带民事诉讼精神损害赔偿的理解与适用——以一起强制猥亵案为分析样本

Compensation for Spiritual Damage in Civil Suits Collateral to Criminal Proceedings and Its Application:Taking a Case of Forced Indecency as an Example

随着民事权利的保护越来越受到重视,民事立法中关于精神损害赔偿的规定也日益完善,但我国刑事法律却拒斥精神损害赔偿制度的存在。为有效解决刑事诉讼中的精神损害赔偿问题,文章以检察机关办理的一起强制猥亵案为切入口,对二审法院判决撤销一审法院在刑事附带民事诉讼中支持精神损害赔偿的做法提出质疑,继而从历史渊源、制度惯性、思想观念等三个方面对刑事附带民事诉讼拒斥精神损害赔偿的原因进行分析,并就积极构建和持续扩张“一般不予受理”的例外情况进行路径探索。

With more and more attention is paid to protection of civil rights,the provisions of our civil legislation on compensation for mental damage are also increasingly improved.However,the criminal law of our country rejects the existence of the system of compensation for spiritual damage.In order to effectively solve the problem of compensation for mental damage in criminal proceedings,this paper takes a case of forced indecency handled by the procuratorial organ as the entry point,and questions the court of second instance’s decision to revoke the court of first instance’s support for compensation for mental damage in civil suits collateral to criminal proceedings.Then,it makes an investigation on the reasons from three aspects:historical origin,institutional inertia and ideology.On this basis,it explores the path of actively constructing and continuously expanding the“generally inadmissible”exceptions.
