数字监察本质上是一种技术治理,是现代信息技术在国家监察中深度嵌入和充分融合的产物。就技术治理而言,技术嵌入在提升效能的同时激活了负效应,造成治理目标实现存在偏差,技术异化、主体“绑架”以及“技”“治”失衡共同催生了技术治理的悖论。数字监察遵循技术治理悖论的混合逻辑而走向失灵,制造了权利焦虑,潜藏着权利风险。对此,消解数字监察的权利风险,需要摆脱技术“奴役”,重塑主体性意识;打破权力“控制”,构建正当性程序;纠正技治“错配”,优化制度性供给。

Digital supervision is essentially a kind of technological governance,which is the product of the deep embedding and full integration of modern information technology in national supervision.As far as technological governance is concerned,technology embedding stimulates negative effects while improving efficiency,leading to the deviation of governance goals,technological alienation,subject″kidnapping″.The imbalance between″technology″and″governance″has jointly spawned the paradox of technological governance.Digital supervision follows the hybrid logic of the paradox of technological governance and become malfunctioning,creating rights anxiety and potential rights risks.In this regard,to eliminate the right risk of digital surveillance,it is necessary to get rid of the technological″enslavement″and reshape the sense of subjectivity,to break down the″control″of power and construct due process,and to correct the″mismatch″of technology and governance and optimize systemic supply.
